⊙Research Results
Historical Changes of Contract Concepts and their Interpretation (Journal of Legal Studies, No. 2, 2004). The author made an attempt to reflect on the research methods and paradigms of private law history. By means of historical evidence and knowledge archaeology, he pointed out that under the cover of homographs, contract concepts have a fundamental break in meaning which may be the dual contract explanation mode that includes Chinese type contract and modern European and American type contract.
The Teleological Interpretation of the Theory of Abstraktionsprinzip (Journal of China Law, No. 2, 2005), which explains the theory of Abstraktionsprinzip in a teleological approach, justifies the advancement of this approach by revealing the internal connections and meaning of the external system of civil law, and critically reflects the prevalence of functionalism in Chinese academic circles in this field.
Research on the Causal Theory (China University of Political Science and Law Press, 2005), which from the perspective of legal culture explores the origin of the causal theory and systematically fills the gaps in Chinese civil law in respect of this theory. The traditional theory of “determinism of will”, as the explanatory mode of the validity of contract (or legal act), lacks of ethical legitimacy, while the causal theory that carries the judgment of ethical values can solve the above problem and eradicate the contradictions in the design of specific systems.
